Terms of Service

1. About these Terms

These Terms of Service ("Terms") are a legal agreement between you and Shabeeb TK ("Goatza", "we", "us") governing your use of the Goatza website, mobile applications and related services (the "Platform").

By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

These Terms should be read together with our Privacy Policy, Community Guidelines and Youth Safety Policy, which form part of this agreement.

2. Who we are

Goatza is operated by Shabeeb TK, sole proprietor trading as "Goatza", based in Kannur, Kerala, India.

As a sole proprietorship, Goatza has no separate legal personality. The proprietor named above is the party to this agreement. Our postal address is available on written request to goatza.official@gmail.com.

Goatza is a platform for athletes, coaches, scouts and sporting organizations. It allows you to build a sporting profile, share content, follow and message other users, and discover or publish recruitment opportunities such as trials and selection events.

Goatza is a platform, not an agent. We do not employ, represent, endorse, sponsor or vet athletes, coaches, scouts or organizations. We do not organise trials, select players, or guarantee outcomes.

3. Eligibility and age

You must be at least 13 years old to create an account. There are no exceptions.

If you are under 18, you are a "child" under Indian law and additional rules apply to you:

• You must have permission from a parent or legal guardian to use the Platform.
• You must provide guardian contact details before applying to any recruitment.
• Your account is subject to the restrictions set out in our Youth Safety Policy.
• We do not profile you, track your behaviour, or serve you targeted advertising.

We collect your date of birth at registration and use it to apply these rules. Providing a false date of birth is a breach of these Terms and we may suspend or remove your account.

If you are a parent or guardian and believe your child has created an account without your permission, contact us at goatza.official@gmail.com and we will remove it.

4. Your account

You are responsible for your account and everything done through it.

• Provide accurate information, and keep it up to date.
• Keep your password confidential. Do not share your account.
• One account per person. Do not create an account for someone else without their authority.
• Tell us promptly at goatza.official@gmail.com if you believe your account has been accessed without permission.

You may sign in using email, phone number, or a Google account. If you use Google Sign-In, your use of Google's service is governed by Google's own terms.

5. Acting on behalf of an Organization

Goatza allows you to act either as yourself or on behalf of an Organization (such as a club or academy) where you hold an Owner, Admin or Coach role.

When you act as an Organization:

• You confirm you are authorised to bind that Organization. Posts, messages, recruitments and decisions made in the Organization's name are attributed to and binding on the Organization.
• The Organization is responsible for the conduct of all its members acting in its name.
• The Organization's Owner is responsible for managing member roles and removing members who should no longer have access.
• If your role is removed, you lose the ability to act for that Organization, but content already published in its name remains attributed to the Organization.

We may suspend or remove an Organization page where we reasonably believe it was created without authority, misrepresents a real organization, or is being used to breach these Terms.

6. Verification badges

Some Organizations display a verification indicator on the Platform.

Verification means only that we have carried out a basic check of the details submitted to us. It is not an endorsement, a background check, a safeguarding certification, or a guarantee that the Organization is legitimate, solvent, safe, or suitable to work with minors.

You must not rely on a verification badge as a substitute for your own due diligence. Do your own checks before attending a trial, sharing personal information, or paying any money.

7. Your content

You keep ownership of everything you post: your posts, images, videos, comments, profile information, career history, achievements and application materials ("Your Content").

To operate the Platform we need permission to handle it. By posting Your Content, you grant us a non-exclusive, worldwide, royalty-free licence to host, store, copy, reformat, resize, transcode, cache, distribute and display Your Content, solely for the purpose of operating, securing and improving the Platform, and only to the audience you have selected through your visibility settings.

This licence:

• Ends when you delete Your Content, subject to the deletion timelines in our Privacy Policy.
• Does not allow us to sell Your Content or licence it to third parties for their own purposes.
• Does not allow us to use Your Content in advertising without your separate consent.
• Continues for copies that other users have lawfully saved or shared, and for copies retained in backups until they expire.

You confirm that you own Your Content or have the rights to post it, and that it does not infringe anyone else's rights.

Content featuring other people. If you post footage or images of other people, including teammates, you are responsible for having their permission. If the footage features a minor who is not you, you must have their guardian's permission.

8. Acceptable use

You must not use the Platform to:

• Post anything unlawful, defamatory, obscene, hateful, harassing or threatening.
• Post sexual content, or any content that sexualises a minor. This results in immediate permanent removal and, where required, a report to the authorities.
• Impersonate any person or organization, or misrepresent your affiliation.
• Contact a minor for any purpose unrelated to legitimate sporting activity, or attempt to move a conversation with a minor off the Platform.
• Post false, misleading or fabricated recruitment opportunities.
• Solicit payment through deception, or run any scheme designed to extract money from athletes or their families.
• Infringe anyone's intellectual property.
• Scrape, crawl, harvest or bulk-extract data from the Platform, or access it by automated means without our written permission.
• Attempt to breach, probe or circumvent the Platform's security, rate limits or access controls.
• Interfere with the operation of the Platform or place unreasonable load on it.
• Resell, sublicense or commercially exploit access to the Platform.

Our Community Guidelines set out these rules in more detail and form part of these Terms.

9. Recruitments and applications

Organizations may publish recruitment opportunities such as trials, selection camps and open days ("Recruitments"). Users may apply to them.

What we do: we host the listing, we let you submit an application, and we deliver it to the Organization.

What we do not do: we do not verify that a Recruitment is genuine, that a trial will take place, that selection criteria will be applied fairly, or that any promised benefit will be provided.

When you publish a Recruitment, you confirm that:

• It is genuine and you are authorised to publish it.
• The details you state, including dates, venue, age categories, eligibility criteria and any fee, are accurate.
• You will handle applicants' personal data lawfully, use it only to assess their application, and not disclose it to third parties without consent.
• Where the Recruitment is open to applicants under 18, you have appropriate safeguarding arrangements in place.

When you apply to a Recruitment, you agree that the information in your application, including your name, contact details, profile data, any media you attach and your answers to the Organization's questions, will be shared with that Organization.

If you are under 18, you must provide the name and contact number of a parent or legal guardian, and confirm that they have consented to your application. We may contact them to verify this.

You may withdraw an application at any time, but we cannot recall information the Organization has already received.

10. Fees and payments

Goatza does not process payments. We never handle money between users and Organizations.

An Organization may state a fee for a Recruitment. That fee is a matter entirely between you and the Organization. We are not a party to it.

Accordingly:

• We do not collect, hold, escrow, refund or guarantee any payment.
• We are not responsible if a fee is taken and the trial does not happen, or does not match its description.
• We cannot recover money on your behalf.

Be careful. Requests for advance payment are the most common form of fraud in sports recruitment. Verify the Organization independently before paying anything. If you are under 18, involve your parent or guardian before any payment. Report suspicious listings to us at goatza.official@gmail.com.

11. Messaging

The Platform allows direct messaging between users and Organizations.

• Messages from people you do not follow may arrive as a request, which you can accept or decline.
• You may block any account at any time. Blocking prevents further contact.
• We do not monitor private messages routinely, but we may access them where necessary to investigate a report, comply with law, or protect someone's safety.
• Messages you send are not encrypted end-to-end and should not be treated as confidential.

If you receive a message that makes you uncomfortable, especially if you are under 18, block the sender and report it. If you are a minor, tell a parent, guardian or trusted adult.

12. Moderation, suspension and termination

We may remove content, restrict features, or suspend or terminate an account where we reasonably believe these Terms or the Community Guidelines have been breached, where we are required to by law, or where necessary to protect users, particularly minors.

Where practical we will tell you what happened and why, and you may respond by writing to goatza.official@gmail.com. For serious breaches, particularly those involving the safety of minors, we may act immediately and without notice.

You may close your account at any time by writing to us at goatza.official@gmail.com. We will confirm your request and complete the closure within 30 days. What happens to your data on closure is described in our Privacy Policy.

Sections 7 (as to licences already granted), 10, 14, 15, 16, 17 and 19 survive termination.

13. Reporting content and grievance redressal

If you see something that breaks these Terms, use the report option in the app.

We have appointed a Grievance Officer under the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021:

We will acknowledge a complaint within 24 hours and resolve it within 15 days of receipt.

Complaints about content that exposes a person's private area, shows nudity or sexual conduct, or impersonates someone, will be actioned within 24 hours of a valid complaint.

14. Third-party services

The Platform depends on third-party services, including cloud hosting, media storage and delivery, push notification delivery, email delivery, sign-in providers and location data. These are listed in our Privacy Policy.

We are not responsible for the availability, accuracy or conduct of third-party services, or for content on external sites we link to.

15. Our intellectual property

The Goatza name, logo, design, software, database structure and all content we create belong to us or our licensors. Nothing in these Terms transfers any of it to you.

You may not copy, modify, reverse-engineer, or create derivative works from the Platform, except as permitted by law.

16. Disclaimers

The Platform is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranty that it will be uninterrupted, error-free, secure, or that any content on it is accurate.

Specifically, we do not warrant:

• that any Recruitment is genuine, or that any trial or opportunity will take place;
• that any user or Organization is who they claim to be;
• that any user or Organization is safe or suitable to interact with, including with minors;
• that any outcome, selection, offer, contract or career opportunity will result from your use of the Platform.

Any meeting, trial, training session or transaction arising from the Platform takes place at your own risk. If you are under 18, do not attend any in-person event without a parent or guardian's knowledge and, where appropriate, their presence.

17. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for loss of opportunity, reputation, data or profits.

Our total aggregate liability to you for all claims arising from or relating to the Platform is limited to the greater of (a) the total amount you have paid us in the twelve months before the claim, or (b) INR 10,000.

Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability for fraud or for death or personal injury caused by our negligence.

18. Indemnity

You agree to indemnify us against any claim, loss, liability or expense (including reasonable legal fees) arising from your breach of these Terms, your content, or your unlawful use of the Platform.

19. Changes to these Terms

We may update these Terms. When we do, we will change the version number and the "last updated" date at the top of this page.

• For minor changes, we will post the updated Terms.
• For material changes, we will notify you in the app or by email, and ask you to accept the new version before you continue using the Platform.

Continuing to use the Platform after a change means you accept the updated Terms.

20. Governing law and jurisdiction

These Terms are governed by the laws of India. The courts at Kannur, Kerala, India have exclusive jurisdiction over any dispute arising from them.
